The state of Michigan agreed to a $55 million unemployment insurance settlement to resolve claims it failed to properly handle collections appeals.
The settlement benefits individuals from whom the State of Michigan Unemployment Insurance Agency collected money while a protest or appeal was pending, after a claimant attempted to protest or appeal but was unable to access services or after a claimant submitted a protest or appeal that was not processed between March 1, 2020, and April 25, 2024.
Plaintiffs in the debt collection class action lawsuit claim the Michigan Unemployment Insurance Agency continued to collect from consumers despite pending appeals. According to the class action lawsuit, the agency should have halted collections until these appeals were processed.
The Michigan Unemployment Insurance Agency provides temporary financial assistance to unemployed individuals.
The Michigan Unemployment Insurance Agency hasn’t admitted any wrongdoing but agreed to pay $55 million to resolve the debt collection class action lawsuit.
Under the terms of the settlement, class members can receive a pro rata share of the net settlement fund based on the amount they were charged in improper collections. Class members may be eligible for enhanced payments if they suffered additional documented damages such as bankruptcy, eviction, repossession of property and mental health treatments.
The deadline for exclusion and objection is Nov. 4, 2024.
The final approval hearing for the settlement is scheduled for March 20, 2025.
To receive a settlement payment, class members must submit a valid claim form by Nov. 4, 2024.
Who’s Eligible
Individuals from whom the State of Michigan Unemployment Insurance Agency collected money while a protest or appeal was pending, after a claimant attempted to protest or appeal but was unable to access services or after a claimant submitted a protest or appeal that was not processed between March 1, 2020, and April 25, 2024.
Proof of Purchase
Documentation of bankruptcy, eviction, mental health treatment and/or vehicle repossession.
